§ 9.04.040. Burning.

  • No person shall burn leaves, trash and rubbish within the street right-of-way.

    A.

    Open Burning Prohibited. No person, firm or corporation shall build any outdoor fire within the corporate limits of the city of Juneau excepting as set forth in subsection (b) of this section. This prohibition on burning includes burning of construction waste and debris at construction sites and any yard waste or household garbage, including any item that may commonly be recycled.

    B.

    Exceptions.

    1.

    Outdoor cooking over a fire contained in a device or structure designed for such use.

    2.

    In ground pits, for recreational use, shall not exceed thirty-six (36) inches in diameter.

    3.

    Ceremonial campfires or bonfires, with prior written approval of the fire chief.

    4.

    Aboveground fires, for recreational use, contained in a device or structure designed for such use.

    C.

    Chief May Prohibit. The fire chief is permitted to prohibit any or all fires when atmospheric conditions or local circumstances make such fires hazardous,

    D.

    Burning on Streets. No materials may be burned upon any street, curb, gutter or sidewalk.

    E.

    Fire Department Exemption. The Juneau fire department is exempt from the provisions of this section for fires for training, controlled burns, and similar fires under the supervision of the fire department.

    F.

    Liability. Persons utilizing and maintaining outdoor fires shall be responsible for any liability resulting from damage caused by their fire.
