§ 9.04.190. Regulation of smoking on public property.

  • A.

    Definitions:

    "Cigarette" means any roll of tobacco wrapped in paper or any substance other than tobacco.

    "Electronic smoking device" means any product containing or delivering nicotine or any other substance intended for human consumption that may be used by a person to simulate smoking through inhalation of vapor or aerosol from the product. This includes any such device whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, e-hookah, or vape pen, or under any other product name or descriptor.

    "Tobacco product" means any form of tobacco prepared in a manner suitable for smoking but not included in a cigarette.

    B.

    No person may use any cigarette, tobacco product, or electronic smoking device at and/or within any of the following locations in the city of Juneau:

    1.

    City hall;

    2.

    Public safety building;

    3.

    City garage;

    4.

    Juneau Utility Offices;

    5.

    Juneau Wastewater Treatment Plant;

    6.

    Juneau Public Library;

    7.

    Juneau Community Center;

    8.

    Within ten feet of any entrance to the Juneau Community Center;

    9.

    Any city-owned park, excluding adjoining parking lots;

    10.

    Any city-owned restroom;

    11.

    Any city-owned playground area;

    12.

    Any concession stand or meeting room owned by the city;

    13.

    Pump houses, sheds, and other city-owned minor buildings.

    C.

    The person in charge of any restaurant, tavern, private club or retail establishment located in an area subject to this ordinance may designate an outside area that is a reasonable distance from any entrance to the restaurant, tavern, private club, or retail establishment where customers, employees, or persons associated with the restaurant, tavern, private club, or retail establishment may smoke.
